These general conditions of online sale govern the contract for the sale of the products offered by NASTROELLE through its website www.nastroelle.com.
They refer to both holders of VAT numbers and to individuals by entering the personal code.
The customer declares to have read all the aforementioned information and general conditions of sale, before placing the order.
The customer also declares to have the legal capacity to undertake in accordance with the provisions of these general conditions.
1 - Object
These general conditions of sale have as their object the definition of the rights and obligations of the parties in the context of a distance sale of goods offered in the online shop www.nastroelle.com
2 - Territory and coverage of the offer
This version of the general conditions of sale refers exclusively to sales made to consumers having their domicile or residence in Italy and Europe.
3- Receipt of order
Any order confirmation signed by the validation click constitutes an irrevocable commitment of the customer that can be called into question only in the cases provided for by this contract in the articles "Right of withdrawal" and "Execution of the order".
4 - Order acceptance
The conclusion of the contract will take place only upon confirmation of the order by Nastroelle.
The customer will receive by e-mail a notification of receipt showing the order confirmation with all the elements of the contract (including products ordered, prices, dates delivery, shipping costs).
Nastroelle cannot be held responsible for mistakes in delivery due to inaccuracies or incompleteness in the way of the purchase order by the customer.
In addition, Nastroelle cannot be held responsible for any damage that may occur to the products after delivery to the forwarder responsible for their transport as well as for delays in delivery .
5 - Availability of products
The offers contained on this site will be valid as long as the products listed remain online and while stocks last.

6 – Prices
The prices of the items are expressed in Euros for each product and are excluded from VAT at 22% for Italy. This will be calculated at the check-out of the order and inclusive of the CONAI contribution if due.

The payment of the amount shall be due from the time of the order. The customer undertakes to pay the agreed price for the ordered product on the site (price of products and transport) by means of the available payment methods.
In case of non-receipt of payment, Nastroelle reserves the right to cancel the order. In the case of payment by credit card, Nastroelle reserves the right to request the sending, within 24 hours, of a copy of the identity document proving the actual ownership of the credit card used, it being understood that, in the absence of the sending requested Nastroelle will be able to refuse payment and cancel the order.

8 - Transfer of risks
The transfer of risks to the customer takes place upon delivery of the products to the carrier by Nastroelle. In the withdrawal period referred to in Article 13, the customer is responsible for the object as custodian. In case of damage or destruction of the product during the custody of the customer, the latter will suffer all the consequences.
9 - Execution of the order
The order will be executed within the terms specified on the web-site and upon acceptance of the order by Nastroelle and in any case within 30 days of confirming the order subject to the availability of the product ordered and unless specifically agreed between the parties.
In case of out of stock or unavailability of the ordered product, Nastroelle undertakes to inform the customer as soon as possible and to specify a possible term for renewed availability. I specify that these terms are indicative and do not bind the seller in any way.

Shipment to Italy
The delivery involves a transport cost of € 14.00 for Italy, excluding the regions of Calabria, Sardinia, Sicily whose cost of transport is increased by € 20.00.
On the other hand, it is free for collections at our office, for purchases over € 250.00 excluding VAT, for Italy.
In the case of bulky goods, we reserve the right to cancel the order and contact the customer again for the transport charge. These conditions apply only to online orders.
Shipment to Europe
Delivery involves a transport charge of € 40.00 (for all European Union countries)
To avoid unpleasant disputes, the buyer is invited to carry out checks on the incoming goods. Any complaints must be made promptly and directly to the carrier upon receipt of the goods and reported on the delivery note. Failure to dispute presupposes an intact and correct delivery. Delivery
Unless otherwise agreed in writing, any delivery time indicated is not binding on the Seller. Unless otherwise agreed between the parties, the indicative delivery time is that specified in the order confirmation.
Any liability for delivery deriving from force majeure or other unforeseeable events not attributable to the Seller, including, without any limitation, strikes, lockouts, provisions of the public administration, subsequent blocks of the possibilities of export or import, in consideration of their duration and of their scope, release the Seller from the obligation to respect any agreed delivery deadline.
The Seller is not obliged to accept returns of the products, unless it has been expressly agreed in writing. Any costs incurred for this purpose are borne by the buyer.
Unless otherwise indicated in writing by the Buyer, the Seller will ship the goods to the address indicated in the order confirmations or in the proforma invoices sent to the Buyer; in the event that the Purchaser, after the products have been shipped, wishes to have the goods delivered to a different address, the costs for redirecting the shipment to a new address, including storage costs and any other costs charged by the carrier , will be entirely borne by the buyer.
The geographical area of delivery corresponds to the geographical area covered by the offer. Deliveries are made from Monday to Friday.The products are delivered to the address indicated by the customer. Delivery is to the street level unless otherwise indicated. The request for delivery to the floor of an order (where available) must be indicated by the customer at the time of the final confirmation of the order.
Nastroelle, without prejudice to the provisions of art. 6, undertakes to deliver the products to the address communicated by the customer in the purchase order, through the carrier responsible for transporting them.
Nastroelle cannot be held responsible for errors in delivery due to inaccuracies or incompleteness in the completion of the purchase order by the customer. In addition, Nastroelle cannot be held responsible for any damage that may occur to the products after delivery to the carrier responsible for transporting them as well as for delays in delivery attributable to the latter.
Nastroelle carries out deliveries throughout Italy and Europe by means of couriers selected by Nastroelle;
The delivery document issued by the carrier, dated and signed by the customer upon delivery of the product, will constitute proof of transport and release of the goods.
Therefore, on delivery, Nastroelle recommends the customer to check the status of the products delivered before signing the receipt document.
If anomalies are found, the customer must refuse the delivery of the products or put in writing their reservations, detailed and dated. These reservations must be confirmed to Nastroelle by registered letter with return receipt within three (3) working days following the delivery of the products.
Duty of Inspection and Acceptance of Products.
Upon taking delivery of the Products, the Purchaser must immediately:
check the quantities and packaging of the Products and record any objection in the delivery note; carry out a conformity check of the Products with respect to what is indicated in the order confirmation and record any discrepancies in the delivery note.
In the event of a complaint of defects, the Purchaser must comply with the following procedures and terms:
- the communication must be made within no more than 3 (three) working days from the taking over of the Products by the Purchaser. In the event that the dispute relates to a defect that, despite the initial inspection, has remained hidden, the complaint must be made as soon as possible by the end of the working day in which the defect was discovered and, in any case, no later than 2 (two) weeks from taking delivery of the Products;
- the detailed communication must be sent in writing to the Seller within the terms indicated above. Any communication made by telephone is not accepted;
- the communication must clearly specify the type and amount of the alleged defects;
- the Purchaser agrees to make the disputed Products available for inspection; this inspection will be carried out by the Seller or by an expert appointed by the Seller.
No dispute with reference to the quantity, quality, type and packaging of the Products may be made except through the communication affixed to the delivery note, in accordance with the above procedure.
Company closing periods
The company closing periods are in the months of December and August (with dates to be defined annually). This year the company will be closed from 2 to 27 August 2021 inclusive and during the Christmas period from 22 December to 7 January 2022 inclusive.
During the company closing periods NO deliveries are made and the fulfillment of the order placed is not guaranteed, even for goods ready for delivery. We therefore invite you to make sure that the offices are actually open.
In case of orders placed during the closing period, the same will be processed at the time of reopening and delivered as soon as possible: orders will be processed according to the arrival date.
11 - Collection of products in case of absence of the customer
In case of absence of the recipient during the delivery, the carrier will leave a notice of passage to the delivery address indicated by the customer. In case of absence of the recipient even on the second delivery attempt, the products must be collected at the address and in the manner indicated by the carrier.
In case of failure to collect within the deadline set by the carrier, the products will be returned. Nastroelle reserves the right to refund the price of the products, leaving the cost of shipping, storage and return to be paid by the customer.
12 - Right of withdrawal
The customer has the right to withdraw from the Contract, without any penalty (except for transport costs) and without specifying the reason, starting from the receipt of the order confirmation sent by Nastroelle. no later than fourteen days from receipt of the product at the address indicated for delivery.

If the product has already been delivered, the customer is required to return it to Nastroelle.
- if there has been delivery of the product, the substantial integrity of the product to be returned is an essential condition for exercising the right of withdrawal. the customer must send the product properly packaged and packaged; Nastroelle does not accept returns that are damaged, but kept in a normal state of conservation, kept with the use of normal diligence.
Products damaged by detergents / additives, or products damaged by the customer due to inexperience will not be replaced or refunded. The customer must insert a copy of the delivery document received inside the packaging box. The risks of transport for the return of the products are fully borne by the customer.
- The costs of returning the goods to Nastroelle are charged to the customer. If the customer exercises the right of withdrawal in accordance with the provisions of these conditions of sale, Nastroelle will reimburse the sums paid by the customer on the same payment method used by the customer for the original transaction (credit card, paypal, bank transfer)
13 – Warranty
(a) The Seller warrants that the Products are free from defects and conform to the technical specifications declared by the Seller.
(b) The warranty applies only to products used in the environment and for applications consistent with the specifications declared by the Seller; any improper use is to be considered prohibited.
(c) The warranty will not be valid if the problem or anomaly results from incorrect or unsuitable applications for the product, from incorrect storage or storage of the product or if it does not comply with commissioning. Any modification or replacement of parts of the product not authorized by the Seller releases the manufacturer from civil and criminal liability, however, making the warranty void. The warranty does not cover normal wear parts.
14 – Liability

Therefore, every responsibility of Nastroelle is excluded for any and all direct or indirect damage caused to people or things by the improper use of the products supplied. In no case can Nastroelle be held responsible, even indirectly, for the failure or insufficient functioning of the products and / or for consequential damage.
